Alhamdu lillah.
Ba ya halatta a auri zaaniyah ko zaani sai dai idan sun tuba. Idan namiji ko macen ba su tuba ba to auren bai inganta ba.
Allaah yace (fassarar ma'anar):
"Mazinaci - mazinaci ba ya aure sai mazinaciya - mazinaciya ko Mushrika.; da mazinaciya – mazinaciya, babu mai aurenta sai mazinaci - mazinaci ko Mushriki [kuma wannan yana nufin mutumin da ya yarda ya yi aure (yi jima'i da) a Mushrika (Mushrikiyar mace, arna ko yar bautar gumaka) ko karuwa, to, lalle ne, ko dai mazinaci ne - fasikanci, ko kuma Mushrik (mushiriki, arna ko mai bautar gumaka). Da kuma matar da ta amince da auren (yi jima'i da) a Mushrik (mushiriki, arna ko mai bautar gumaka) ko mazinaci - mazinaci, to ko dai karuwa ce ko kuma Mushrika (Mushrikiyar mace, arna, ko yar bautar gumaka)]. Irin wannan abu haramun ne ga muminai (na Tauhidi Musulunci)”

Akwai wani rahoto dangane da dalilin saukar wannan ayar wanda ya kara bayyana hukunci. Abu Dawood (2051) An karbo daga Amr bn Shu’aib, daga babansa, daga kakansa, cewa Marthad bn Abi Marthad al-Ghanawi ya kasance yana safarar fursunoni daga Makkah. Albaniy ne ya sanya shi a cikin Saheeh Abi Dawud.
A cikin ‘Awn al-Ma’bood yana cewa:
Wannan yana nuni da cewa bai halatta ga namiji ya auri macen da ta fito fili ta yi zina ba. Wannan yana nuni da ayar da aka kawo a hadisi, domin a karshensa, yana cewa: "Wannan abu haramun ne ga muminai". Wannan ya nuna a fili haramun ne. Ƙarshen magana.
Al-Sa'di (Allah yayi masa rahama) in ji tafsirinsa akan ayar da muka kawo a sama:
Wannan yana nuna cewa zina abin kyama ce kuma tana zubar da mutuncin wanda ya aikata ta ta yadda wasu zunubai ba su yi ba.. An gaya mana cewa babu macen da za ta auri zaani sai za’aniyya mai kama da shi ko mushrika wanda ya yi shirka da Allaah kuma bai yi imani da tashin kiyama ko lada da azaba ba., kuma baya bin umarnin Allaah. Haka abin ya shafi zaaniyah: babu mai aurenta sai zaani ko mushriki. "Irin wannan abu haramun ne ga muminai" ma'ana: haramun ne a gare su su auri zaani ko zaaniyya.
Abin da ayar ke nufi shi ne wanda ya auri mutum, namiji ko mace, Wanda ya yi zina kuma bai tuba ba, to, ko dai wanda bai yi riko da hukunce-hukuncen Allaah da ManzonSa ba., don haka ba zai iya zama komai ba face mushriki, ko kuma yana bin dokokin Allaah da Manzonsa ne amma yaci gaba da wannan auren duk da yasan wannan zina., indai haka auren zina ne da fasikanci. Da ya kasance mai imani da Allaah, ba zai yi haka ba.
Wannan yana nuna a fili haramun ne a auri za’aniyya har sai ta tuba, ko ya auri zaani har sai ya tuba, saboda zumuncin da ke tsakanin namiji da matarsa ko mace da mijinta shi ne mafi kusancin zumunci. Allaah yace (fassarar ma'anar): “Ku tara waɗanda suka yi zalunci, tare da sahabbansu” [al-Saffaat 37:22]. Don haka Allaah ya haramta hakan saboda babban sharrin da yake tattare da shi. Hakanan yana nuna rashin kishi mai karewa kuma yana nuna cewa yara ana iya danganta su ga mijin da ba nasa ba., zaani ba zai rike mata tsafta ba domin wani ya shagaltu da shi. Duk daya daga cikin wadannan zai wadatar ya zama haramun. Ƙarshen magana.
Sheikh Ibn Usaimin (Allah yayi masa rahama) yace wani abu makamancin haka, kuma ya ce ma’anar ayar ita ce, wanda ya yarda da auren za’aniyya haramun ne amma har yanzu ya aure ta ya kulla auren haramun da yake ganin haramun ne.. Kwangilar haram kamar wadda babu ita ce, don haka bai halatta a gare shi ya kusanci mace ba; a haka mutumin zai zama zaani.
Amma idan ya musanta cewa haramun ne ya auri za’aniyya ya ce ya halatta, to a wannan yanayin mutumin mushriki ne, saboda ya halatta wani abu da Allaah ya haramta kuma ya sanya kansa a matsayin dan majalisa tare da Allaah. Wannan shi ne abin da muke cewa mutumin da ya aurar da 'yarsa ga zaani.
Fataawa al-Mar'ah al-Muslimah, Ashraf Abd al-Maqsood ya harhada (2/698).
Wannan (i.e. cewa haramun ne a auri zaaniyya) ya zo a cikin fatawowin Shaihu Muhammad bn Ibrahim (Allah yayi masa rahama) da kuma malamai na zaunannen kwamitin bayar da fatawa, karkashin jagorancin Shaikh Ibn Baaz (Allah yayi masa rahama).

Shaikhul Islam Ibn Taimiyah yace:
Saboda azabar da Allaah ya hukunta masu aikata zina, Ya haramta auren muminai, a matsayin tsawatawa gare su kuma saboda zunubai da munanan ayyuka da suke da su. … Don haka (Allaah) ya gaya mana cewa babu mai yin haka sai zaani ko mushriki.
Amma ga mushriki, ba shi da imanin da zai hana shi yin fasikanci ko kuma yin tarayya da masu yin su.
Amma zaani, Fasiqancinsa ne ke sa shi yin hakan ko da kuwa ba mushriki ba ne.
Allaah ya hore mu da nisantar alfasha da al'ummarta matukar suna yin haka, kuma wannan ya shafi zaani.
Allaah ya shar'anta maza su kasance masu kamun kai ba fasikanci ba, kamar yadda yake cewa (fassarar ma'anar): “Duk sauran halal ne, muddin kuna nema (su a cikin aure) da Mahr (kudin amaryar da mijin yake baiwa matarsa a lokacin daurin aure) daga dukiyar ku, Mai son tsafta, rashin yin jima'i ba bisa ka'ida ba" [al-Nisa' 4:24]. Wannan wani abu ne da bai kamata a yi watsi da shi ba domin Alkur'ani ya bayyana shi karara.
Amma haramcin auren za’aniyah, fuqaha', kamar sahabban Ahmad da sauransu, sun tattauna kuma akwai rahotanni game da shi daga salaf. Ko da yake fuqaha’u sun yi savani game da shi, wadanda suka ce halal ba su da wata kwakkwarar hujja. Ƙarshen magana.

Ya kuma ce (32/110):
Auren zaaniyya haramun ne sai dai in ta tuba, shin ko shi ne ya yi zina da ita. Babu shakka wannan shine madaidaicin ra'ayi, kuma shi ne mahangar adadin mutanen farko da na baya, ciki har da Ahmad bn Hanbal da sauransu.
Wannan shi ne abin da Alqur’ani da Sunnah suka nuna. Nassin da ya fi shahara a kan hakan shi ne ayar Suratul Nur inda Allaah Ya ce (fassarar ma'anar):
"Mazinaci - mazinaci ba ya aure sai mazinaciya - mazinaciya ko Mushrika.; da mazinaciya – mazinaciya, babu mai aurenta sai mazinaci - mazinaci ko Mushriki [kuma wannan yana nufin mutumin da ya yarda ya yi aure (yi jima'i da) a Mushrika (Mushrikiyar mace, arna ko yar bautar gumaka) ko karuwa, to, lalle ne, ko dai mazinaci ne - fasikanci, ko kuma Mushrik (mushiriki, arna ko mai bautar gumaka). Da kuma matar da ta amince da auren (yi jima'i da) a Mushrik (mushiriki, arna ko mai bautar gumaka) ko mazinaci - mazinaci, to ko dai karuwa ce ko kuma Mushrika (Mushrikiyar mace, arna, ko yar bautar gumaka)]. Irin wannan abu haramun ne ga muminai (na Tauhidi Musulunci)”

A cikin Sunnah, akwai hadisin Abu Marthad al-Ghanawi da ‘Anaaq. Ƙarshen magana.
Wanda ya fuskanci wannan matsalar kuma ya yi aure kafin ya tuba ya tuba zuwa ga Allaah ya yi nadamar abin da ya aikata., kuma ku ƙudura cewa ba za ku sake yin wannan zunubin ba, sai ya sake yin daurin auren.
Kuma Allaah ne Mafi sani.
